2. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:

• Violate applicable laws or regulations

• Attempt to gain unauthorized access to systems

• Interfere with service functionality

• Use the platform for fraudulent activity

• Upload plans or documents you do not have the right to use

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate information

• Maintain confidentiality of login credentials

• Accept responsibility for all account activity

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions, Pages, and Payments

Estim8 Pro offers subscription-based plans that include a monthly allowance of plan pages, plus optional one-time page bundles for active subscribers. By subscribing:

• You authorize recurring billing through your app store account

• Fees are charged according to your selected plan

• Unused monthly page allowances do not roll over unless otherwise stated

• Page bundles are one-time purchases available to active subscribers

• You may cancel at any time through your app store subscription settings; cancellation takes effect at the end of the current billing period

• Refunds are provided only as required by law or by the applicable app store's refund policy

We may change pricing with reasonable notice.

5. Estimating Disclaimer

Estim8 Pro uses artificial intelligence to generate takeoffs, material counts, and estimates from the plans you provide. These outputs are provided as a starting point and productivity tool only. They may contain errors or omissions, and accuracy depends on the quality and completeness of the plans you upload.

You are solely responsible for reviewing and verifying all takeoffs, quantities, pricing, and estimates before using them in any bid, contract, purchase, or construction decision. Estim8 Pro does not provide professional estimating, engineering, architectural, or legal advice, and its outputs are not a substitute for review by a qualified professional.

6. Intellectual Property

All content, branding, designs, logos, and software related to Estim8 Pro are owned by us or licensed to us and are protected by intellectual property laws. You may not copy, reproduce, distribute, or modify any part of the Services without written permission.

You retain ownership of the plans and documents you upload. By uploading them, you grant us a limited license to process, store, and analyze them solely to provide the Services and improve their accuracy. You represent that you have the necessary rights to upload any plans you submit.

7. Limitation of Liability

To the maximum extent permitted by law, Estim8 Pro and dvcapps shall not be liable for:

• Indirect or consequential damages

• Loss of profits or data

• Bids, contracts, purchases, or construction decisions made based on takeoffs or estimates provided

• Service interruptions

Use of the Services is at your own risk.

8. Termination

We may suspend or terminate your access if you violate these Terms or engage in harmful behavior. You may also terminate your account at any time.

9. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
